I attended the BoCC meeting on December 8th , 2021 and spoke during the “call to the audience,” saying: “This is the third time now I’ve asked to be placed on the agenda, to have a public discussion about not being allowed to be placed on the ballot for Sheriff. I do not have an issue with providing fingerprints to verify that I have not committed a felony. The issue is that this acquisition is Voluntary.”
Previously, I provided a Sworn Affidavit stating that I have not committed a felony to the County Recorder, who was then instructed to deny my access to the ballot (read previous editorials for more information). As mentioned, my objection isn’t providing fingerprints for verification. In fact, I did get my fingerprints done at the Montezuma County Sheriff’s office in Cortez and showed them to the Commissioners; no response. It’s by force that you surrender your Constitutionally protected rights (and they are not or I wouldn’t be doing this now), rights which should be protected under the Bill of Rights. Didn’t our County Board just proclaim Archuleta County as a Constitutional County? Doesn’t that mean they have a sworn duty to protect and defend our rights? One of those rights is the 4th Amendment right to privacy.
Funny how the Colorado Bureau of Investigation states the form for the fingerprints is called “Privacy Act Notification”. Classic. It should be called the “You Have No Rights Act” because this goes way beyond verifying if you have ever had a felony. I wonder how many attorneys it took to come up with this ambiguous language. Words like: “generally authorized,” “could,” “may,” “otherwise responsible agency,” and “disclose without your consent” are thrown in the form to make it appear that they have the authority to violate your rights, in order to control the narrative by forcing you to “voluntarily” forfeit them if you want the position. Isn’t that entrapment, coercing individuals and any other office or position that requires a background check? And to top it off they want you to pay for the pleasure of the background check as well, $17.50.
I asked them (BoCC) if they had read the handout (Privacy Act Notification) I provided to them at the last meeting, which demonstrated my concerns. I’d be surprised if they did not want to question our County Attorney’s authority. Who is actually running our county? Well I again didn’t get any response from them, just another blank stare.
Today, December 9th, I called the Colorado Bureau of Investigation. After the agent I spoke with was unable to answer my questions, she finally passed me up to her supervisor. It’s as if they’ve never been asked these questions before. I asked the supervisor the same questions to which she to couldn’t answer either, questions regarding wording on the form, including:
- Entering fingerprints into Next Generation Identification?
- Any Successor system?
- Latent fingerprint repositories?
- Other available records of employing?
- Responsible agencies?
- FBI’s blanket uses, like to any third party they deem?
- “May” be disclosed without my consent!?
Apparently stating the Privacy Act of 1974 gives them the authority to violate my rights. WOW, this is scary.
I could hear she was getting frustrated. She couldn’t answer any of my concerns. Finally, she says: “If you want your Sheriff to get the report you must sign it and agree to all stipulations or no report will be issued for verification. Your application will be denied.” Can I say entrapment? I expressed my concerns relating to the FBI and that I didn’t trust them with my personal identification information. A few examples as to why being:
- Let’s remember what they did to the last President “Russian-gate”.
- Labeling parents who object to subjects taught to their children (such as critical race theory) as Domestic Terrorists.
- Breaking into the Mesa County Recorders home for exposing voter fraud.
This is just the tip of the FBI’s totalitarianism agenda and I’m supposed to trust them with my personal identity?
That an alphabet soup agency can make Unconstitutional demands which violate your Constitutional Rights and get away with it without consequences is just one of the many reasons I’m running for Sheriff. This is the epitome of totalitarianism and it’s being unlawfully enforced upon us. We have got to put a stop to this hijacking of our Republic and quickly. We are running out of time. As Thomas Jefferson wrote in the Declaration of Independence:

But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.”

Wow. I am amazed at how corrupt government has gotten. If all the things that you were saying Wayne are true, where the people must stand up. I believe in freedom count me in as a soldier for that
